Hamilton Judge Blocks Dignified Burial for Aborted Babies

COLUMBUS, Ohio— Today, Ohio Right to Life responds to the ruling from the Hamilton County Court of Common Pleas on SB 27 regarding the disposition of fetal remains following a surgical abortion.
SB 27 was passed into law by Ohio’s elected legislature and signed by the Governor in 2020. It set procedure for surgical abortion providers to handle babies’ remains with dignity and respect. Ultimately, the bill allowed the birth mother to determine the appropriate care for her child’s remains after the abortion. The radical ACLU forum shopped and found a judge in Hamilton County to overall the will of the Ohio Legislature and the Governor of Ohio.
“SB 27 offered respect and dignity to children who lost their innocent lives to abortion. A dignified burial is not a burden to have an abortion. It is the least we as Ohioans can provide to these kids,” said Ohio Right to Life President, Mike Gonidakis. “Sadly, we live in a state where a local judge who is not accountable to the people of Ohio can eliminate the will of the Ohio legislature and Governor. The radical pro-abortion community continues to prostitute our rule of law and state constitution by shopping around to find the most liberal pro-abortion local judge to rewrite state law. We fully expect our pro-life Attorney General Dave Yost to appeal this inappropriate decision. The American people are exhausted by what is happening at the federal judiciary and now within our state courts. The role of the courts is to interpret the law and not to make law.”
